Sales Program Privacy Policy
Effective date: October 2, 2026
This Sales Program Privacy Policy (this "Policy") explains how PMV 2, LLC, a Texas limited liability company doing business as Watt Choice ("WattChoice," "we," "us," or "our"), collects, uses, shares, retains, and protects personal information when you apply to, join, or use the WattChoice Sales Program. It covers Sales Partners and the limited Customer information tied to your Sales Code.
It does not replace the consumer Privacy Policy, which governs each Customer's own WattChoice Account, bills, and Smart Meter Texas data. Read both if you also use WattChoice as a Customer. Capitalized terms not defined here have the meanings in the Sales Program Terms or the consumer Terms.
This Policy is a counsel-ready operational draft. It is not legal advice to you.
1.Who We Are

WattChoice decides the purposes and means of processing Sales Partner information for the Program. Amazon Web Services processes Program data as our processor. ComparePower, Payless Power, REPs, and payment or tax processors receive only what they need for checkout attribution or payouts. SMT is not used to register you as the Customer.
2.Scope and Age
This Policy applies to Program applications, Sales Codes, tracked links, partner dashboards, payout records, tax forms, and communications about the Program. It applies to Sales Partners who are at least sixteen (16) years old. If you are 16 or 17, a parent or legal guardian must also accept the Sales Program Terms, and we may collect that guardian's identity and contact information.
Customer bill images, SMT interval usage, hashed passwords, and full Account files are processed under the consumer Privacy Policy. Sales Partners do not receive that full file by default. This Policy does not cover information a Customer shows you on their own screen, or information you collect on your own devices outside WattChoice.
3.Information We Collect About You
Depending on your application and Program use, we may collect the following. We do not collect every item for every applicant.
3.1Identity and contact
- Name, title, email, phone, and language preference
- Date of birth or age representation, so we can confirm you are at least 16
- If you are 16 or 17: parent or legal guardian name, email, phone, and consent record
- Signup date and signup source
3.2Organization
- Legal entity name, entity type, address, and website
- Tax identification number
- Years in business, employee count, and sales-rep count
- Markets served and sales channel (for example door-to-door, telemarketing, commercial, or referral)
- Licenses, permits, and insurance status you disclose
3.3Program profile and performance
- Sales Code and tracked-link identifiers
- Clicks, attributed signups, comparisons started, enrollments, confirmation or order IDs, and related timestamps
- Dashboard login and role
3.4Payout and tax
- Payout account details you submit
- Tax forms (for example Form W-9) and tax classification
- Commission ledgers, adjustments, and clawbacks
3.5Technical and security
- IP address, browser and device information
- Login and session records
- Security or audit events
- Cookies needed for dashboard session and language
- Transactional email delivery receipts
4.Customer Information Tied to Your Sales Code
If a Customer uses your tracked link or Sales Code, we record that attribution on their WattChoice session. For Program operation we may show you limited status, such as that a referred Customer started, completed a comparison, or enrolled, plus a confirmation or order ID when a partner or REP returns one. We may also show a truncated name or premise city if needed to distinguish two referrals, but we aim to show the minimum needed to operate compensation.
We do not, by default, give Sales Partners the Customer's bill image, hashed password, SMT interval history, average monthly kWh detail, full ESIID or meter file, or LOA text. The Customer may choose to show you their screen or forward a result. Their consumer Privacy Policy still controls that data. You will not copy it into your own list or sell it.
A Sales Partner cannot exercise a Customer's privacy rights, delete a Customer's Account, or revoke SMT access on the Customer's behalf, unless the Customer has appointed you in a written authorized-agent designation that we accept.
5.How We Collect It
- Directly from you: application forms, emails, tax forms, dashboard updates, and guardian consent if you are 16 or 17.
- Automatically: cookies, Sales Code clicks, session and audit logs, and email delivery receipts.
- From the Customer flow: attribution when they use your link; enrollment or order IDs from ComparePower, Payless Power, or a REP checkout.
- From processors: Amazon Web Services for hosting, storage, and email; payment or tax processors for payouts.
6.How We Use It
We use Program information to:
- Review Program applications, confirm you are at least 16, and issue or revoke Sales Codes
- Confirm parental or guardian acceptance when you are 16 or 17
- Attribute enrollments and calculate, adjust, or claw back Program compensation
- Operate dashboards, authentication, fraud prevention, and audit logs
- Send Program email (acceptance, payout, policy updates, and legal notices)
- Issue tax forms and comply with tax reporting
- Investigate complaints, slamming allegations, or PUCT or law-enforcement requests
- Establish, exercise, or defend legal claims
We do not use Customer SMT interval data to market to you, and we do not sell Sales Partner or Customer energy or usage data to data brokers.
7.Sharing
We share Program information with Amazon Web Services (hosting, storage, email); with Smart Meter Texas only as needed for a Customer's own SMT request, not to register you as the Customer; with ComparePower and Payless Power or a REP when a tracked checkout needs a referral or pixel identifier; with payment or tax processors for payouts and Forms 1099; with professional advisors under confidentiality; and with regulators, law enforcement, or a buyer in a corporate transaction as described in the consumer Privacy Policy.
We do not sell Sales Partner or Customer energy or usage data to data brokers. Commission sharing with you is payment for an Attributed Enrollment, not a sale of Customer data. To the extent the Texas Data Privacy and Security Act applies, we do not sell Program personal data as that chapter defines sale, and we do not use it for third-party targeted advertising.
8.Security
We use TLS in transit and AES-256 at rest via AWS. Passwords are stored hashed, never in plaintext. You are responsible for the security of your own devices, scripts, and any Customer information a Customer shows you outside the dashboard. Notify support@watchchoice.net promptly if you believe your Program login or Sales Code has been compromised.
9.Retention
Unless we tell you otherwise, we apply these timelines:
- Program application, identity, guardian-consent records, Sales Code, consent, payout, and tax records: life of the relationship plus 7 years.
- Performance logs (clicks, attributed signups, enrollments, confirmation or order IDs): 24 months, except that records needed for a commission or tax dispute follow the 7-year payout schedule.
- Session, IP, device, security, and audit logs: 24 months.
- Customer attribution records: retained with the Customer's Account on the consumer Privacy Policy schedule.
Leaving the Program ends new attribution. It does not erase historical payout or tax records we must keep. When retention ends, we delete or de-identify the information, except for limited backup or legal-hold copies.
10.Your Rights
You may request access, correction, or deletion of your Sales Partner profile by emailing support@watchchoice.net with the subject line "Sales Privacy Request." We may keep records required for tax, commission disputes, fraud prevention, or law. We will verify your identity before fulfilling a request.
To the extent the Texas Data Privacy and Security Act applies to you as a consumer (for example if you applied as an individual and not solely in a commercial context), you may also have the rights described in the consumer Privacy Policy, including appeal of a denial. A parent or legal guardian of a Sales Partner who is 16 or 17 may exercise those rights on their behalf.
Customers exercise their own rights under the consumer Privacy Policy. A Sales Partner cannot delete a Customer's WattChoice Account on their behalf.
11.Children and Partners Under 16
The Program is offered only to individuals who are at least sixteen (16) years old. We do not knowingly collect Program applications from anyone under 16. If you believe we have collected information from someone under 16, contact support@watchchoice.net and we will delete the application and any Sales Code, except a limited record needed to prevent re-application or to comply with law.
12.Location of Processing
We and AWS process Program information in the United States. The Program is intended for sales activity directed at Texas retail electric customers.

We may update this Policy and will post the new effective date on the Services. Material changes may also be emailed to the address on your Program profile. Continued Program use after the effective date is acceptance. If you do not agree, stop using the Program and request that we revoke your Sales Code.
