Terms and Conditions

Effective September 10, 2026

These Terms and Conditions (the “Terms”) are a binding agreement between you and PMV 2, LLC, doing business as Watt Choice (“WattChoice,” “we,” “us,” or “our”). They govern your access to and use of https://watchchoice.net and related websites, applications, onboarding flows, comparison tools, and communications (collectively, the “Services”).

By creating an account, checking a box, clicking to accept, uploading a bill, signing a Letter of Authorization, authorizing Smart Meter Texas access, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

WattChoice is not a Retail Electric Provider, a transmission and distribution utility, or your electric company. The retail electric contract for any plan you enroll in is solely between you and the Retail Electric Provider you select.

1.Defined Terms

  • “ESIID” means the Electric Service Identifier assigned to a Texas electric service premise.
  • “ETF” means an early-termination or cancellation fee charged by a Retail Electric Provider under your existing retail electric contract.
  • “LOA” means a Letter of Authorization or similar written or electronic authorization by which you appoint WattChoice as your designated agent or representative for the limited purposes described in these Terms.
  • “REP” means a Retail Electric Provider certified by the Public Utility Commission of Texas to sell electricity to retail customers.
  • “SMT” means Smart Meter Texas, the statewide portal used to authorize and retrieve interval meter and usage data.
  • “TDU” means a transmission and distribution utility that delivers electricity to your premise.
  • “you” means the individual using the Services, and, if you act for a household or account, the person with legal authority to bind that account.

2.Agreement and Electronic Consent

You consent to conduct business with WattChoice electronically under the federal Electronic Signatures in Global and National Commerce Act (the ESIGN Act) and the Texas Uniform Electronic Transactions Act (Texas Business & Commerce Code Chapter 322). You agree that electronic records, click-to-accept actions, checkbox acknowledgments, and electronic signatures have the same legal effect as a handwritten signature on a paper document.

This consent covers your account, the LOA, SMT authorization, onboarding documents, consents to these Terms and the Privacy Policy, and related notices. You represent that you can access and retain electronic records, including by using a supported web browser, a valid email address, and the ability to view PDF or image files.

You may withdraw electronic consent by emailing support@watchchoice.net. Withdrawal is prospective only. If you withdraw, we may close your account and stop providing the Services because the Services depend on electronic records and signatures. Withdrawal does not cancel a retail electric contract you already formed with a REP.

3.Eligibility and Authority

The Services are offered to individuals who are at least 18 years old and who have a Texas service address in an area open to retail electric competition, or who are the authorized agent of such a person. You represent that the information you submit is accurate and that you are the account holder, or that you have legal authority to access the premise, ESIID, meter, bills, and utility account you submit.

You may not use the Services to access another person’s utility account, SMT data, or bills without that person’s authorization. Unauthorized access may result in immediate termination and may be reported to the affected REP, SMT, or law enforcement.

4.The Services

WattChoice provides a comparison and facilitation service. Depending on the features you use, we may:

  • Accept and extract information from uploaded electricity bills.
  • Collect account, premise, and plan details you provide.
  • Request and use SMT interval usage and meter attributes after you complete SMT’s own authorization.
  • Estimate what you would pay on available plans, including fees where our data allows.
  • Recommend or display plans and provide tracked links or hosted checkout to third-party enrollment flows.
  • Act as your limited agent under an LOA to obtain information and communicate about a potential switch.

Plan prices, availability, eligibility, and enrollment are controlled by REPs and their marketing or checkout partners. Estimates are illustrative. They are not a quote, a guaranteed rate, or an offer by WattChoice to sell electricity.

PMV 2, LLC, doing business as Watt Choice, holds Public Utility Commission of Texas registration number BR260170. WattChoice is not your REP, TDU, or electric utility and does not generate, transmit, or sell electricity.

5.Letter of Authorization and Agency

If you sign or accept an LOA, you appoint WattChoice as your designated agent and authorized representative, solely to the extent needed to provide the Services. The grant of authority includes permission to:

  • Request, receive, and review SMT interval usage, historical consumption, and meter attributes for your ESIID or meter.
  • View and use utility account, premise, plan, billing, and contract information you provide or that we extract from your bill.
  • Communicate with SMT, your current or prospective REP, a TDU, or a checkout partner about your service location, usage, eligibility, and a potential enrollment or switch.
  • Submit or confirm information reasonably required to start or complete a comparison or enrollment handoff.

The LOA does not authorize WattChoice to become your REP, to bind you to a retail electric contract without your checkout or enrollment action, to access bank or payment credentials except as a checkout partner may collect them on its own site, or to act beyond the Services.

The LOA remains in effect while your WattChoice account is active, or until you revoke it, whichever comes first. You may revoke the LOA at any time by emailing support@watchchoice.net or using an in-product revocation control if one is available. Revocation is prospective. It does not undo a retail contract already formed with a REP, cancel SMT’s own records, or erase information we must retain for legal, audit, or dispute purposes.

6.Smart Meter Texas Access and Data Authorization

To retrieve interval usage history, historical consumption, and meter attributes, WattChoice relies on SMT. You acknowledge that SMT, not WattChoice, will email you to approve data sharing, and that WattChoice cannot skip, pre-check, or complete that approval for you.

By authorizing SMT access, you instruct SMT to allow WattChoice to query interval usage data, historical consumption, and meter attributes associated with your premise, ESIID, or meter, for the purposes in these Terms and the Privacy Policy. SMT’s own terms and authorization process also apply. If SMT access expires, is denied, or is revoked, usage-based comparison features may stop working until you authorize again.

7.Third-Party Services, Comparison, and Checkout

Plan comparison, service-location lookup, product availability, enrollment, and checkout may be provided or hosted by third parties, including ComparePower (service-location lookup, plan comparison, and hosted or embedded checkout) and Payless Power (product and pricing availability and provider-hosted enrollment). Other REPs or marketing partners may also host enrollment.

WattChoice is an intermediary and advisor. We may send location, ESIID, usage, and plan-selection data to those parties so they can return rates or complete checkout. When you continue to a hosted checkout or enrollment page, you leave WattChoice and enter that party’s or the REP’s terms, privacy policy, and enrollment contract.

The retail electric contract is solely between you and the chosen REP. WattChoice is not a party to that contract and is not responsible for the REP’s rates, billing, service, deposits, credit checks, or ETFs. Your former REP may charge an ETF under your existing contract. WattChoice does not set, waive, or collect that fee.

Third-party prices, plans, and availability can change without notice. Checkout can fail because of partner outages, ineligibility, credit, address, or ESIID mismatches, or REP rules. We disclaim responsibility for those failures to the maximum extent permitted by Texas law.

8.Compensation and No Charge to You

The Services are free to you. If you enroll in a plan through a tracked link, hosted checkout, or other attributed path, a REP or its marketing partner may pay WattChoice a commission or similar compensation. That payment does not increase the price you pay the REP because of WattChoice. In-product copy may disclose that providers pay us if you switch.

9.User Responsibilities and Account Security

You agree to provide complete and accurate information, including your legal name, email, phone number, service and billing addresses, current REP, electricity account number, ESIID, meter identifier, bill uploads, and plan or contract details. You are responsible for errors that result from inaccurate or unauthorized submissions.

You are responsible for maintaining the confidentiality of your credentials. Passwords are stored in hashed form and are never stored in plaintext. You must notify support@watchchoice.net promptly if you believe your account has been compromised. WattChoice may treat actions taken through your account as authorized by you until we receive and process a security notice.

10.Acceptable Use

You will not misuse the Services, including by uploading malware, scraping beyond normal interactive use, interfering with security or audit controls, impersonating another person, submitting another person’s utility account without authority, or using the Services for any unlawful purpose.

We may suspend or terminate access if we reasonably believe you have violated these Terms, created risk for another customer, or used the Services in a way that could harm SMT, a REP, a TDU, or our partners.

11.Intellectual Property

WattChoice and its licensors own the Services, including software, design, text, and trademarks. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial Texas electricity comparison. You retain rights in the bills and account information you submit. You grant WattChoice a license to host, process, extract, and display that information as needed to provide the Services and as described in the Privacy Policy.

12.Disclaimers of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, WATTCHOICE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that bill extraction, usage analysis, rate comparisons, or savings estimates will be accurate, complete, or error-free; that a recommended plan will be available at checkout; that switching will save you money after ETFs, TDU charges, taxes, or usage changes; or that SMT, ComparePower, Payless Power, AWS, or any REP will be uninterrupted or correct.

13.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, WATTCHOICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST SAVINGS, LOST PROFITS, LOST DATA, OR REPLACEMENT POWER COSTS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID TO WATTCHOICE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some Texas consumer protections cannot be waived. Nothing in these Terms limits liability that cannot be limited under applicable law.

14.Indemnification

You will defend, indemnify, and hold harmless WattChoice and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of: (a) inaccurate, incomplete, or misleading information you submit; (b) your unauthorized access to or submission of another person’s utility account, ESIID, meter, bill, or SMT data; (c) your violation of these Terms or applicable law; or (d) your retail electric contract with a REP, including ETFs, deposits, and billing disputes with that REP, except to the extent caused by WattChoice’s willful misconduct.

15.Term, Termination, and Revocation

These Terms apply from your first use of the Services until your account is closed. You may stop using the Services and request account closure by contacting support@watchchoice.net. You may revoke the LOA and SMT authorization as described above. We may terminate or suspend the Services if you breach these Terms, if a partner withdraws access, or if we discontinue the product.

Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law) survive termination.

16.Dispute Resolution, Arbitration, and Class-Action Waiver

Before filing a claim, you agree to email support@watchchoice.net a written description of the dispute and to allow thirty (30) days for an informal resolution.

If the dispute is not resolved, it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Harris County, Texas, or by video or telephone if the rules allow. The arbitrator may award the same individual relief a court could award.

YOU AND WATTCHOICE WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Either party may bring an individual action in small-claims court in Harris County, Texas. You may opt out of arbitration within thirty (30) days after you first accept these Terms by emailing support@watchchoice.net with the subject line “Arbitration Opt-Out” and your name, email, and Watt user ID. If the class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not in arbitration.

17.Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for any court proceeding lies in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

18.Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on the Services and revise the effective date. Material changes may also be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance of the updated Terms, except where Texas law requires additional consent.

19.Miscellaneous

These Terms, the Privacy Policy, and any LOA or SMT authorization you accept are the entire agreement between you and WattChoice regarding the Services. If a provision is held unenforceable, the remainder stays in effect. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Failure to enforce a provision is not a waiver. Headings are for convenience only.
