This Privacy Policy explains how PMV 2, LLC, doing business as Watt Choice (“WattChoice,” “we,” “us,” or “our”), collects, uses, shares, and retains personal information when you use https://watchchoice.net and related Services. It should be read with our Terms and Conditions.

WattChoice is a Texas-focused electricity comparison and switch-facilitation service. We do not sell personal energy or usage data to third-party data brokers.

1.Scope

This Policy covers information we collect through the website, account signup, bill upload, electronic signatures and consents, Smart Meter Texas authorization, plan comparison, checkout handoff, email, and related support. It does not control how a Retail Electric Provider (REP), Smart Meter Texas (SMT), ComparePower, Payless Power, or another checkout host uses information after you leave WattChoice or after they collect it on their own sites.

3.Categories of Personal Information We Collect

Depending on how you use the Services, we may collect the following categories and data points.

3.1 Identity and account

  • Watt user ID
  • First name and last name (or full legal name)
  • Email address
  • Phone number
  • Password, stored only in hashed form, never in plaintext
  • Billing address
  • Signup date
  • Signup source (for example, referral code, tracked link, or the path you used to create an account)
  • Language preference
  • Consent records for the Terms, this Privacy Policy, SMT access, and electronic signature
  • Signed Letter of Authorization (LOA)

3.2 Utility and premises

  • Electricity service address
  • Current Electricity Provider / REP
  • Electricity account number
  • ESIID (Electric Service Identifier)
  • Meter number or other meter identifier

3.3 Contract, plan, and enrollment

  • Current electricity plan name
  • Contract term
  • Contract start date
  • Contract end or expiration date
  • Rate
  • Billed rate
  • Cancellation or early-termination fee (ETF)
  • Selected or recommended electricity plans and checkout activity
  • Confirmation or order ID from a partner or REP enrollment

3.4 Usage, billing, and meter data

  • Uploaded electricity bill (PDF or image) and information contained in it
  • Last bill upload date
  • Electricity usage and Smart Meter Texas usage history
  • Average monthly kWh
  • SMT authorization expiry
  • Billing amounts, balances, charges, payments, credits, and rates

3.5 Technical, security, and communications

  • IP address
  • Browser and device information
  • Timestamps
  • Login and session records
  • Security and audit events
  • Transactional email delivery information (for example, sent, delivered, or bounced receipts)

4.How We Collect Information

We collect information in three ways.

4.1 Information you provide directly

You provide identity, contact, premise, and account details through forms. You upload bills. You accept Terms and this Policy, complete electronic signatures, and sign an LOA. You may complete SMT’s email approval. You may start checkout with a partner or REP.

4.2 Information collected automatically

When you use the Services, we record IP address, browser and device signatures, timestamps, login and session records, security and audit events, language preference (including a locale cookie), and transactional email delivery receipts. We use cookies and similar technologies as described below.

4.3 Information from third-party integrations

After you authorize SMT, we may retrieve interval usage, historical consumption, meter attributes, and related SMT authorization metadata, including SMT authorization expiry. We may receive service-location, plan, rate, availability, and checkout or confirmation data from ComparePower and Payless Power, and confirmation or order IDs from a REP or enrollment host.

5.How We Use Information

We use personal information to operate and improve the Services, including to:

  • Create and maintain your account (Watt user ID, name, email, phone, language, signup date, and signup source).
  • Authenticate you, manage sessions, prevent fraud, and keep security and audit logs.
  • Extract bill details and record the last bill upload date.
  • Analyze usage patterns, including SMT history and average monthly kWh.
  • Calculate rate comparisons using your plan name, contract term, contract start and end, rate, billed rate, and ETF.
  • Process electronic LOAs and SMT authorizations, and track SMT authorization expiry.
  • Facilitate a switch or enrollment and store confirmation or order IDs.
  • Send transactional email (verification, SMT-related notices, and service messages) and record delivery receipts.
  • Comply with law, respond to Public Utility Commission of Texas (PUCT) or other regulatory requests, and establish, exercise, or defend legal claims.

6.Third-Party Sharing and Disclosures

We share information with the following categories of recipients when needed to provide the Services or as required by law.

6.1 Amazon Web Services (AWS)

AWS provides cloud hosting, encrypted storage, bill-extraction / OCR pipelines, email infrastructure, and core backend processing. AWS may process account, bill, usage, and technical data as our processor.

6.2 Smart Meter Texas (SMT)

We share the identifiers SMT requires to process your authorization and to query meter and electricity-usage data, such as your name, email, service address, ESIID, and meter identifier. SMT returns usage history, meter attributes, and authorization status or expiry.

6.3 ComparePower

We share service-location, ESIID, usage, and related comparison inputs so ComparePower can look up the location, return plan rates, and operate hosted or embedded checkout. ComparePower may receive checkout activity and return confirmation or order IDs.

6.4 Payless Power

We share location, usage, and plan-selection information as needed for product and pricing availability and provider-hosted enrollment. Payless Power or the enrolling REP may receive enrollment details and return a confirmation or order ID.

6.5 Legal, regulatory, and corporate transactions

We may disclose information if required by law or legal process; to respond to PUCT, law-enforcement, or other government requests; to protect customers, the Services, or the public; or in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.

7.We Do Not Sell Energy or Usage Data

WattChoice does not sell personal energy or usage data to third-party data brokers. We do not share that data with marketers for their independent advertising, and we do not use it to run third-party ads. We may receive a commission from a REP or its marketing partner if you enroll through an attributed path, as described in the Terms and Conditions. That compensation is for a facilitated switch, not a sale of your data to a data broker.

8.Cookies and Similar Technologies

We use a locale cookie to remember whether you view the site in English or Spanish. In production we may also use strictly necessary cookies or similar storage for session management, security, and fraud prevention. You can control cookies in your browser. Disabling cookies may limit language persistence or login features.

9.Data Security

We use TLS to encrypt information in transit and AES-256 encryption for data at rest via AWS. Passwords are stored strictly in hashed form and never in plaintext. No method of transmission or storage is completely secure. You are responsible for keeping your credentials confidential.

10.Retention

We retain information only as long as needed for the purposes in this Policy, unless a longer period is required by law, dispute, or audit. Unless we tell you otherwise, we apply these timelines:

Account profile, Watt user ID, consents, and LOA records

Life of the account plus 7 years after closure

Uploaded bills, extracted bill contents, and last bill upload date

Life of the account, or 3 years after closure, whichever period we need to complete a comparison, enrollment, or dispute

SMT usage history, average monthly kWh, and related meter data

While SMT or LOA access is active, plus 90 days after revocation or SMT authorization expiry

Contract and enrollment records (REP, plan name, term, start and end, rate, billed rate, ETF, confirmation or order ID)

Life of the account plus 7 years

Session, IP, device, security, and audit logs

24 months

Transactional email delivery receipts

24 months

Signup date, signup source, and language preference

Life of the account plus 7 years

When retention ends, we delete or de-identify the information, except where backup or legal-hold copies must persist for a limited additional period.

11.Your Rights, Choices, and Revocation

You may request that we update your first name, last name, email, phone, addresses, or language preference, or that we correct account information, by emailing support@watchchoice.net.

You may request deletion of your account and personal information. We will honor the request except where we must retain records for law, security, LOA or consent proof, enrollment disputes, or the retention periods above. Deletion of WattChoice records does not delete your retail account with a REP or SMT’s own records.

You may revoke your LOA and SMT authorization at any time by emailing support@watchchoice.net or using an in-product control if available. Revoking SMT access or allowing SMT authorization to expire disables usage-based comparison that depends on interval history until you authorize again. Bill-upload comparison may still be available if you provide a bill.

To the extent the Texas Data Privacy and Security Act or other law gives you rights to access, correct, delete, or obtain a copy of personal data, or to appeal a refusal, you may exercise those rights through support@watchchoice.net. We will not discriminate against you for exercising a privacy right.

12.Children

The Services are not directed to children under 18, and we do not knowingly collect personal information from children under 18. If you believe we have collected such information, contact support@watchchoice.net and we will delete it.

13.Changes to This Policy

We may update this Policy from time to time. We will post the revised Policy on the Services and change the effective date. For material changes, we may also notify you by email or in-product notice. The updated Policy applies to information we already hold, except where applicable law requires otherwise.

If you have an unresolved privacy concern, you may also contact the Public Utility Commission of Texas regarding retail electric issues, or other regulators as applicable, without waiving any right to contact us first.
